The new Law No. 8/2025 introduces several additions and amendments to the existing Law No. 55/2015 “On strategic investments in the Republic of Albania.” Below are the main points of the amendments:
- Land consolidation
The definition of “land consolidation” has been expanded to include:
- The cartographic clarification, readjustment, and reregistration of the property;
- The completion of transitional and special ownership processes;
- Any other measure that enables the utilization and change of the land’s designation.
- Investment portfolio
An investment portfolio is created by the Investment Agency, which includes:
- Three-year plans for the investment development strategy;
- A one-year calendar of investment projects;
- A fund of immovable properties for the support of strategic investments.
- Status of Strategic Investments
The status “Strategic Investment/Strategic Investor, assisted procedure” may also be granted for projects not included in the previously defined sectors, but which have an investment capital exceeding 50 million euros and approval from the relevant ministry.
- Verification of Real Estate
AIDA will carry out cadastral verifications to ensure that the properties proposed for investment:
- Are not subject to restitution or property compensation;
- Are not part of a legal process concerning ownership;
- Are not in the legalization process;
- Are not protected areas or designated as “cultural monuments” or “archaeological zones.“
- Suspension and Cancellation of Investments
- The Strategic Investments Committee may temporarily suspend an investment for a maximum of 2 years if the investor fails to fulfill the obligations undertaken;
- If the investor does not fulfill the obligations within the specified deadline, the status of the strategic investment may be revoked.
- Use of Coasts for Strategic Investments
- The approval for the use of coasts for tourism projects is granted by the Strategic Investments Committee;
- The maximum duration for use is 30 years;
- The usage fees are determined by the relevant municipal council.
- Timelines for Implementation
The deadline for obtaining the special status for tourism investments is extended until December 31, 2026 (from December 31, 2024).
