“License for the Collective Management of Copyright.”

The Ministry of Culture has approved Instruction no. 338, dated 2.6.2023, “On the determination of criteria and procedures for obtaining the license for the collective management of copyright, its renewal, as well as the determination of criteria and procedures for the suspension and revocation of the license in implementation of law no. 35/2016, dated 31.3.2016, “On copyright and related rights”, as amended (the Instruction), published in the Official Gazette no. 87, dated 02.06.2023.

The Instruction defines the criteria and procedures for obtaining and renewing the license for the collective management of copyright and related rights, including the procedure for its suspension or revocation.

Non-profit organizations, in addition to the criteria specified in law no. 35/2016 “On copyright and related rights”, as amended, must also meet certain additional specific criteria for:

Licensing
possesses the right to represent rights holder;
verifies the expression of willingness for reciprocal representation with foreign agencies;
possesses technological equipment and professional expertise to carry out its functions;
applies rules and mechanisms for the distribution and payment of royalties, monitoring the use of copyright and related rights.
renewing
ongoing compliance with the legal body of law in power, which pertains to the internal organization of the legal entity;
submits the annual report and balance sheet;
demonstrates that is has fulfilled its obligations to sister agencies within the framework of mutual agreements.
