The draft decision aims to improve and adapt the existing regulatory framework by simplifying procedures and revising the documentation required for obtaining visas and residence/single permits, with the goal of facilitating the process for applicants.
What does the draft decision introduce?
-Third-country nationals holding a valid multiple-entry visa or residence permit issued by an EU Member State are exempt from the visa requirement for stays up to 90 days within 180 days, for purposes equivalent to a type “C” visa.
-The validity of the Provisional Permit is extended until the final decision is issued. The application fee remains valid for 30 days, allowing reapplication in case of refusal.
Additional documentation for visas
-A residence permit valid for more than 12 months from the country of residence (with at least 3 months validity beyond the visa), or valid visas such as Schengen, US, UK, or Albanian (including electronic visas), is required.
Reduced processing time
-The timeframe for reviewing applications and issuing a single permit is reduced from 12 weeks to 4 weeks from the date of application.
Legal novelties
-Introduction of a specific category for a single permit for domestic workers (D/PSH).
-Introduction of a general requirement to submit a criminal record certificate (not older than 6 months), except for applicants under 16 and over 75 years of age, in line with the principle of proportionality.
-Addition of Chapter IV on the issuance of Registration Certificates for stays longer than 3 months for EU citizens (employees, self-employed, persons with sufficient means, students, or family members).
-Addition of Chapter V on the issuance of Residence Cards for family members of EU citizens who are not themselves EU nationals.
