The new law “On Trademarks,” adopted in July 2025, introduces several significant innovations compared to the previous law, which were necessary for the modernization and alignment of Albanian legislation with international standards and for improving the efficiency of trademark protection. The main innovations of this law include:
- Simplified and clearer registration of trademarks
The new law defines clearer and more efficient procedures for the registration of trademarks, enabling a faster and simpler process for all interested parties, including collective and certification marks.
- Compliance with international legislation
One of the main reasons for the creation of a new law was alignment with the regulations of the European Union and international agreements such as the Paris Convention and the TRIPS Agreement. This alignment is necessary to ensure the protection of trademark rights for individuals and companies operating in Albania.
- Stronger protection for well-known trademarks
The new law provides extended protection for well-known trademarks, offering them stronger protection for goods and services that are not the same as those for which they are registered, but which may harm the reputation of the trademark. This improvement is important for maintaining the integrity of well-known trademarks in the market.
- Protection against unauthorized use of trademarks
The new law strengthens the rights of trademark owners by giving them the opportunity to prevent the unauthorized use of their trademarks. This is an important step in preventing misuse and abuses that may impact the reputation of the trademark and harm consumers.
- Simplified procedure for the transfer of trademarks
The new law has improved the procedures for the transfer of trademark ownership, ensuring that this process is clearly documented and registered in a straightforward manner. This will help avoid confusion and legal uncertainty during trademark transfers.
- Trademark licensing
This law provides for the possibility of trademark licensing, which can be exclusive or non-exclusive, for some or all of the goods and services for which the trademark is registered. This process offers new opportunities for businesses and further protection of trademark rights.
- Improvement of transparency and oversight
The new law contains provisions that enhance transparency and the efficiency of trademark registry oversight, enabling a cleaner and more controlled administration, which will help prevent abuses and violations of trademark rights.
Why was the creation of a new law for trademarks necessary?
The creation of a new law specifically for trademarks, separating it from other industrial property objects, was necessary to:
- Ensure compliance with international legislation and EU regulations.
- Improve the protection and oversight of trademark rights.
- Stimulate business development and create a more favorable climate for investments.
- Strengthen the protection of reputable trademarks and enhance protection against unauthorized use.
This law is an important step towards modernizing Albanian legislation and strengthening the protection of trademarks, providing strong support for economic development and encouraging investments in Albania.
